2.11 Ships to be Licensed (new section)

(viii) No person may operate a kayak on the water between the hours of one (1) hour before sunset to one (1) hour after sunrise.

Background Information:

Commercial operations of craft not subject to Maritime Rules and Safe Ship Management Regimes – particularly commercial kayak operations have increased within the Sounds over the past few years. Additionally, with the increase in use of the Abel Tasman National Park area starting to approach saturation point, it is entirely possible that new commercial kayak operations will be introduced into the Sounds or that existing operations will be expanded.

It is the intention to implement existing industry developed standards in addition to a general expectation to a basic level of safety to which such operations should aim through an operator licensing regime.

Kayaks on the water are very difficult to see at the best of times, but even more so at the times of sunrise and sunset. It is for this reason that restrictions are being placed on kayaks 1 hour before sunset and 1 hour after sunrise. It does not, however, relieve the master or operator of any other ship from the duty of keeping a proper look-out at all times.
